On October 28, 2003, the Equal Justice Center and the Texas Defender Service released a report on the procedures adopted in Texas, over the last two years, for appointment of defense counsel to represent indigent defendants in capital cases. The report is entitled Texas Death Penalty Practices: Quality of Regional Standards and County Plans Governing Indigent Defense in Capital Cases. It examines the procedures adopted and published by officials at the regional and county level and evaluates the degree to which these published procedures comply with the requirements of the Texas Fair Defense Act relating to appointment of capital defense counsel. The report also compares the capital defense standards that have been adopted in Texas with the recently updated American Bar Association Guidelines for Appointment and Performance of Defense Counsel in Death Penalty Cases. These ABA Guidelines represent the current national consensus about what is required to provide effective defense representation in death penalty cases.
